Let's break down gun control
So, why am I not surprised to see the day after another "mass shooting" that people are trying to push gun control through legislation. This is absolutely ridiculous. I do not understand why people keep wanting to pass laws that inhibit their freedoms. Is that not the reason why we live in the United States of America? So, I have a couple talking points that I would like to discuss when it comes to this issue. While some of these go along with "conspiracy theories", the others are just plain common sense.
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed- the 2nd amendment.
infringed- 1. To transgress or exceed the limits of; violate 2. Obsolete To defeat; invalidate.
Section 37. No person, whether or not acting under color of law, shall by force or threat of force, willfully injure, intimidate or interfere with, or attempt to injure, intimidate or interfere with, or oppress or threaten any other person in the free exercise or enjoyment of any right or privilege secured to him by the constitution or laws of the commonwealth or by the constitution or laws of the United States. Any person convicted of violating this provision shall be fined not more than one thousand dollars or imprisoned not more than one year or both; and if bodily injury results, shall be punished by a fine of not more than ten thousand dollars or by imprisonment for not more than ten years, or both.
Now that I have provided the exact wording of the 2nd amendment, provided the exact definition of infringed and the exact law of what the punishment is for those that violate, attempt to manipulate or interfere with a constitutional right. So, in theory I should be able to take every pro gun ban and every senator, house of representative and government official to court and have them either fined, imprisoned or both.
Now, onto my next point. Does any one know why this is one of the most important rights we have? This right was adopted from the English Bill of Rights of 1689. From that document it was meant to be viewed as an auxiliary right, supporting the natural rights of self-defense, resistance to oppression, and the civic duty to act in concert in defense of the state.
Self Defense- this right was given to us so that we would be able to protect ourselves. Self defense is the most effective and fastest way to protect oneself ( I know that sounds dumb but those who disagree are really dumb). Why would we need to rely on others when it comes to the protection of our life? How fast does it take for a police officer to arrive? I mean I could go on and on about this but it wouldn't change the simple fact that self defense is needed in order to survive. Those of you who would not try anything and everything in your power to protect your life do not value your own life. The animal kingdom is filled with self defense mechanisms. Each one is different depending on the predator and/or ability of the organism. Example: a tiger is equipped with speed, strength, claws and teeth. This would be equivalent to a person who had extensive martial arts training and was physically fit. On the other hand, those who are not at the top of the foo chain use methods such as camouflage, poison, group tactics, playing dead, spraying of chemicals, stingers, armor and the list goes on and on. This is equivalent to the average person wielding a gun because a gun is BEST form of personal protection any human can have. I am sorry not everyone can use mind control or can fly away from danger. But when it comes down to it, how is talking going to provide self defense? Are you going to talk the attacker to death? Are you going to call him derogatory names to make him run away in shame? No. How is martial arts going to protect you when the other person is trained better than you are? A knife? A taser? A baseball ball? I mean all of these things can fail but do you know what will work 100% of the time with a well trained individual? A gun. Enough said.
Resistance to oppression- So, are we quick to forget that we as a country where once oppressed by our government before? That history shows that governments have the power to oppress their citizens and keep them in slavery? The very thought of gun control or banning shows that we as the people willingly hold out our hands to be shackled at the wrists. Guns are our last defense when it comes defending ourselves against oppression. If we give that right away, then how can we protect ourselves from the state/government if they should ever decide to take arms against us to make us obey? We as citizens greatly outnumber the government and police force. So why would we take another advantge of the people away, the right to bear arms?
the civic duty to act in concert in defense of the state- We all have a civic duty to protect and defend our state when called upon. That is why it states a well organized militia in the 2nd amendment. Militias were suppose to be the acting "military component" when in peace time and the first line of defense for each individual state from the government. This way, the federal government can’t usurp undue power as the states and the people themselves would be able to stop such a thing. But the 2nd amendment doesn't give the state power either but gives it to the militias and the people. Not only this but why do we think our military is invincible and our borders are untouchable from foreign forces? What would happen if the United States was invaded, would you not want a weapon to defend this country?
We live in a generation of people who want to give up all their rights and sit at home and watch tv. Is that freedom? Gun control is not the problem of America, it's the people holding the guns. Good and evil exists whether or not you believe it. No matter what, people are going to kill people. Whether they use a gun or some other weapon. No one can prevent it.
Does anyone remember what happened when prohibition was passed? That very act created organized crime and drove a huge black market in the United States. Do you not think that banning or controlling guns would do much more?
Anyone who believes universal background checks is going to solve or deter anything in such a degree to prevent gun violence is very ignorant. First, background checks are already in place and they still allowed the Boston Bombing to happen. Both of those individuals had been on the FBI watch list. This is already a small step at infringing the right to bear arms. Secondly, the FBI keeps every background check performed on file and could possibly use it to create a database for whatever reason. Thirdly, where will the money come from to do these background checks? A tax or a fine? Great more money being needed for a useless check. Fourthly, this is going to allow the government to have a database of every weapon being owned to every citizen in the country. Now why would anyone need a database like this? Maybe to come and take our weapons when the country collapses or to further demonize gun owners when a shooting occurs.
I do believe in a mental health evaluation when it comes to those wanting firearms. I believe this would fall under a well regulated militia because obviously mentally incompetent people would not be able to perform in a militia.
We as American citizens should not be worried about trying to suppress our own legally given rights but to as why these events happen. Guns are not the only weapon used in every murder or robbery. If we push to control or ban guns then we need to do the same for every thing that could be used as a weapon. DWIs kill more people a year than guns do but I do not see people up in arms banning vehicles. Heart attacks, stroke, diabetes and other health problems kill more people a year than guns do but I don't see people trying to make all Americans eat healthy and exercise.
“What about our children? They have a right to live,” Robinson said. “We’re standing as mothers and fathers up here. … It’s a constant ache in our heart that we can never get rid of.” This was taken from an article about pushing gun control. The funny thing is, there are more dangerous things in the world than guns. People in other countries die everyday from bombs and airstrikes and blah blah blah. Things happen, people die. That is the way of life. We have evolved as a culture that instead of accepting cycles of life, we find something to blame and destroy it. We don't cope with our pain and fear but push it onto a solution... Wake up America, it's time to grow up.
