Preamble and Existing Successful Federal Pilot Project

As background, here are some "Waterway Facts" from what I refer to as an existing Federal Pilot Project, showing how one such waterways improvement project affected the City of Tulsa Oklahoma, and also other localities along the Verdigris Canal, Arkansas River, Mississippi River, and Gulf of Mexico mutually interlinked federal waterways areas. The successful federal "Pilot Project" is the existing McClellan–Kerr Arkansas River Navigation System (MKARNS) is part of the inland waterway system originating at the Tulsa Port of Catoosa and running southeast through Oklahoma and Arkansas to the Mississippi River. The system was named for two Senators: Robert S. Kerr (D-OK) and John L. McClellan (D-AR), who pushed authorizing legislation through Congress. The system officially opened June 5, 1971. It is operated by the U.S. Army Corps of Engineers. Though it primarily follows the Arkansas River, it also follows portions of the Verdigris River in Oklahoma and the White River in Arkansas. It also includes the Arkansas Post Canal, a short canal named for nearby Arkansas Post National Memorial, connecting the Arkansas and White Rivers.

Through Oklahoma and Arkansas, dams artificially deepen and widen this modest sized river to build it into a commercially navigable body of water. The design enables traffic to overcome an elevation difference of 420 feet (130 m) between the Mississippi River and the Tulsa Port of Catoosa. Along the section of the Arkansas River that carries the McClellan-Kerr channel, the river sustains commercial barge traffic and offers passenger and recreational use and is a series of reservoirs. Total length of the system is 445 miles. To allow for navigation, construction was started in 1963 on a system of channels and locks to connect the many reservoirs along the length of the Arkansas River. The first section, running to Little Rock, Arkansas, opened in 1968. The first barge to reach the Port of Catoosa arrived in early 1971.

Proposed New Federal Water Legislation

As either a separate Bill, or as a constituent part of any new federal water projects or federal waterways pending legislation, please add an amendment having the following key legislative provisions:

1. Under the provisions of the US Constitution seen at Art. 1, Sections 8 & 17, and also Art IV, the provisions of this act shall supersede and displace the provisions of the constitution or laws of any state or commonwealth of the United States, and shall also supersede the provisions of any interstate compact, that are in conflict with the provisions of this law.
2. The below described various revenue streams contemplated for the Federal Waterways and Ports Authority, (hereafter “FWPA”) are intended to provide a variety of cash flows, in which to retire the tax-free waterways investment-grade tax-free quasi-municipal bonds, which multiple revenue sources and bonded indebtedness modes of financing is intended to make the autonomous FWPA, fiscally self-sustaining.
3. The Federal Waterways and Ports Authority anticipated revenues include a variety of FWPA fees, canal, bridge, and tunnel tolls; all water utility, electricity, sewer, and natural gas utility charges to be paid within the boundaries of the federal benefit district federal reservations; registry fees for motor vehicles and boats and trailers utilized within the benefit district federal reservations; the exclusive authority to operate all of the nation’s ports of entry (which by itself effectively recoups $4.8 Billion in revenues otherwise paid-out to private contractors, which perpetually restores full American port of entry security that some say is compromised due to America’s ports operations being in a private contractor’s hands instead of being operated by an entity whose governing body is appointed by the President of the United States. The operation of all U.S. ports of entry, by itself, adds billions of dollars in FWPA revenues); capital gains obtained from real property sales of residential privately-owned parcels such as those situated within the new residential lake communities, the lake community leasehold estate rents to be paid by the large numbers of “build to suit” tenants working on base-plus a percentage-of-sales leases, all of which rents are to be paid for business locations utilized for the sales of services or products to the general public within the FWPA benefit district federal reservations, including tenants occupying the FWPA commercial, industrial, and agricultural tracts,. The FWPA leaseholds include, but are not limited to, all lake community shopping malls, restaurants, grocery stores, convenience stores, marinas, sporting goods and bait and tackle shops, an array of business offices, bakeries, beauty shops, clothing stores, and regional hospitals and medical centers; –- agribusiness rents such as those paid by fish farms producing among other species, gulf shrimp or Alaskan king crab, massive hydroponic greenhouses utilized to raise vegetables and garden produce and grain farms whose growing beds utilize rich agricultural loam mixed with recovered waterways silt, and mushrooms, livestock and poultry raising operations, each of which is located near the markets where they will be consumed, and also worm farms producing baits much-desired by fishermen -- industrial leasehold payments that include rents to be paid by Land-Air-Rail-Sea Port (“LARS Ports”) tenants; U.S. Foreign Trade Zone tenants; warehouses; shipyards and pleasure craft boat factories; brick, block, and cement companies; glass factories; timber mills and lumber yards; and further, the several quasi-municipal fines paid by administrative rules and FWPA infraction violators, and also fees paid in lieu of state and local taxes by persons within FWPA benefit district federal reservations, containing the many lakes, reservoirs, residential, commercial, industrial, and agricultural areas, and also FWPA home-rule charter hamlets, boroughs, or metroplex FWPA benefit district federal reservation residential communities.
4. Collaterally, the works of the Federal Waterways and Ports Authority will create a national reservoir of new jobs and employment opportunities with admired quasi-municipal amenities and lifestyles.
5. There is hereby created as a corporation created by Congress, the FEDERAL WATERWAYS AND PORTS AUTHORITY, as a semi-private, semi-public instrumentality of the United States of America, having as its governing body, a duly sworn Board of Governors consisting of five members to be appointed by the President of the United Sates and before undertaking their responsibilities, to be confirmed by the United States Senate. When appointed, one member of such Board of Governors shall be a resident of the Eastern Time Zone, one member of such Board of Governors shall be a resident of the Central Time Zone, one member of such Board of Governors shall be a resident of the Mountain Time Zone, one member of such Board of Governors shall be a resident of the Pacific Time Zone, and the fifth such member of the Board of Governors shall reside in either: the State of Alaska; the State of Hawaii; the Commonwealth of the Northern Marianas; the Commonwealth of Puerto Rico; (after its admission to the union, the Commonwealth of Novamerica) the US Virgin Islands; the Island of Guam; or, is an enrolled member of any Indian or Eskimo tribal government, or by his or her Native American bloodlines, being related by consanguinity or affinity, is an enrolled member of the Mixed-Blood Tribe of the Native American First Nations (consisting of persons to the uttermost hereditary generation of partial Native American, Hawaiian Native, or Eskimo heritage. The tribal government of which Mixed-Blood Tribe of the Native American First Nations is hereby extended federal recognition by virtue of this Act of Congress, as a federally recognized Indian Tribe, which shall enjoy a tribal constitution to be drafted at a tribal constitutional convention to be held commencing at noon on June 1, 2014, and adjourning with its works accomplished at noon, July 4, 2014, in the heartland of America, at Kansas City, Missouri; and, having as its reservation or homeland tribal territory, the premises in its entirety of Cimarron County, Oklahoma, a total land and water area of 1,842.2 square miles, Cimarron County is the farthest west of the three Oklahoma Panhandle counties. Cimarron is the only county in the United States that touches five states: Kansas, Colorado, New Mexico, Texas, and Oklahoma, which lands are hereby ceded from the State of Oklahoma, (The Act of Admission to the Union relating to the state of Oklahoma, is hereby deemed by operation of law, to be constructively amended, nunc pro tunc, to exclude from the jurisdiction and territory of such state, all of Cimarron County in its entirety, and also all of the lands that are situated within the federal waterways and ports authority benefit district federal reservations, which now, or shall in the future be established.)
6. The lands in what is now Cimarron County, shall enjoy a LARS Port, and shall also be, upon the effective date of this Act shall perpetually remain, the Cimarron Indian Territory, under the territorial and lawful jurisdictions of the Mixed-Blood Tribe of the Native American First Nations. Each of the several tribal governments shall by lottery, be assigned and shall enjoy, a tribal exclusive lawful use easement to occupy three hundred and twenty acres thereof, with its U.S. territorial governor to remain in an ex-officio status, the principal chief of the Mixed-Blood Tribe of the Native American First Nations, and the territorial legislature to remain in an ex-officio status, the legislative branch, of the Mixed-Blood Tribe of the Native American First Nations, and for which a U.S. Territorial Court shall be established and maintained, along with a tribal defense force that is hereby included, along with the defense forces of any federally recognized tribal government, within the statutory provisions of 32 U.S.C. § 109) or any Native American Culture group, now or in the future existing, which tax-exempt organizations are hereby declared to be, a subordinate integrated auxiliary organization of such Mixed-Blood Tribe of the Native American First Nations, which for mutual economic development purposes within FWPA benefit districts or in other locations, any gaming casinos where there are wagers placed on games of skill or chance, or off-track betting offices, to be established by any Native American Culture Group, to be and perpetually remain, joint ventures to be equally-owned between the tribal government of the Mixed Blood Tribe of the Native American First Nations and the governing body of any participating Native American Culture Group.)
7. The initial members of the Board of Governors of the Federal Waterways and Ports Authority, shall be divided into five classes, to serve in office during the remainder of the year in which they were originally appointed and confirmed, together with an additional term extension, with one such class enjoying an initial term extension of five years, one such class enjoying an initial term extension of four years, one such class enjoying an initial term extension of three years, one such class enjoying an initial term of two years, and one such class enjoying an initial term extension of one year; the successors to the initial members of the Board of Governors shall possess five year terms of office, to commence at noon on January 1st, of the first day of the prescribed term of office of each such member of the Board of Governors of the Federal Waterways and Ports Authority, at which time the terms of office of their predecessors shall expire.
8. The Board of Governors of the Federal Waterways and Ports Authority shall consist of a Chairman, a Vice Chairman, a Secretary, a Treasurer, and a Parliamentarian of such Board of Governors, as the President shall determine within his appointments that are transmitted for the advice and consent of the United States Senate.
9. One member of such Board of Governors shall have previous significant, command, or executive experience as, or within: (a) the US Army Corps of Engineers, with respect to hydraulic engineering, lake construction or federal waterways construction and maintenance; (B) the US Navy Seabees; (c) Engineering and construction of either dams, canals, port improvements, or shipyards constructing ocean-going vessels or the manufacturing of seaplane passenger or cargo aircraft; (d) Air, railroad, trucking, or maritime freight dispatching; (e) Residential, commercial, industrial, mixed-use, urban, suburban, agricultural, and public utility and community infrastructure development projects, as either part of Real Estate Brokerage; or, as a General Contractor, for the planning and construction or sales of such major urban, suburban or rural real estate developments.
10. Regarding the authorized FWPA corporate voting capital stock, (a) Twenty percent (20%) of the FWPA voting capital stock shall be held in trust, with the beneficiary of the periodic dividends thereto appertaining being a perpetual endowment for funding the expense of the social security benefits that are paid to qualified recipients by the United States Social Security Administration, as consideration in exchange for the federal instrumentality quasi-municipal powers and exemptions found under the terms of this Act. (b) Twenty percent (20%) of the FWPA voting capital stock shall be held in trust, with the beneficiary of the periodic dividends thereto appertaining being a perpetual endowment for funding annual trust distributions, or loans, made to the employees of the Federal Waterways and Ports Authority, or for Federal Waterways and Ports Authority employee pension plan purposes. (c) Twenty percent (20%) of the FWPA voting capital stock shall be held in trust, with the beneficiary of the periodic dividends thereto appertaining being a perpetual endowment for the creation of FWPA grants, or loans, made to employers whose sales of products or services business operations shall be conducted exclusively within the boundaries of Federal Waterways and Ports Authority benefit district federal reservations, consisting of the premises of the right of way for its waterways, lakes, reservoirs, and development projects, within its integrated industrial, commercial, residential, agricultural, and aquatic real estate developments and projects. (d) Twenty percent (20%) of the FWPA voting capital stock shall be held in trust, with the beneficiary of the periodic dividends thereto appertaining being a perpetual endowment for funding grants, or loans, made to industrial and manufacturing firms making products that are utilized within the boundaries of Federal Waterways and Ports Authority benefit district federal reservations, consisting of the premises of the right of way for its waterways, lakes, reservoirs, and development projects, within its integrated industrial, commercial, residential, agricultural, and aquatic or oceanic real estate developments and projects. And, (e) Twenty percent (20%) of the voting capital stock of the Federal Waterways and Ports Authority shall be held in trust, with the beneficiary of the periodic dividends thereto appertaining being a perpetual endowment for funding grants, or loans, made to maritime passenger and freight transportation firms including, but not limited to, firms such as: shipyards building maritime vessels having non-fossil fuel, or electric, or a hybrid-propulsion system; or pump-jet, hydro jet, or water jet marine systems that creates a jet of water for propulsion; high speed maritime passenger or cargo vessels that are equipped with hydrofoil hulls; the manufacturers of sea plane passenger and cargo aircraft, or deep-water merchant marine vessels or oceanic platforms permanently utilized as man-made islands, or merchant marine facilities, utilized as: commercial sea plane tenders and for open ocean re-charging of maritime vessel electrical propulsion systems, and for aquatic or oceanic hospitality functions, to promote travel abroad, for tourism, business, educational, recreational, or other purposes, including International travel, and also travels to floating fresh water aquatic, or salt water oceanic, surface or undersea locations, including, but not limited to, the coastal waters or deep water projects, to be established and maintained by the board of governors of the federal waterways and ports authority, constituting FWPA benefit district federal reservations.
11. The Board of Governors of the Federal Waterways and Ports Authority, shall periodically issue convertible bonds to be exchanged for preferred shares, and such series of non-voting or preferred shares of capital stock, as shall be necessary or convenient, in order to acquire capital invested by FWPA preferred shareholders, for the purposes of obtaining capital.
12. The FWPA Board of Governors, shall issue tax-free debenture, revenue, real estate, or equipment bonds, as US government instrumentality quasi-municipal bonds that are not backed by the full faith and credit of the United States, to the federal reserve bank system in exchange for federal reserve notes; or, to other bona fide purchasers, for value given in consideration thereof. To promote the adequate financing of the works of the Federal Waterways and Ports Authority (and also other corporate instrumentalities of the United States that according to the congressional charter of each such corporation, shall remit 20% of its capital stocks with dividends as an endowment to pay the obligations of the Social Security Administration); accordingly, the U.S. federal reserve banks shall periodically invest in the US government instrumentality quasi-municipal bonds not backed by the full faith and credit of the United States, to be issued by any semi-private semi-public corporate instrumentality of the United States, including the Federal Waterways and Ports Authority, up to a sum that is equal to twenty percent (20%) of the aggregate total sum of dollars held by the federal reserve bank system, with regard to the issued and outstanding debt obligations of the United States Treasury.
13. After the effective date of this Act, the federal Waterways and Ports Authority shall exclusively operate all ports of entry of the United States of America, and shall retain for its quasi-municipal and public purposes, all of the fees and profits thereto relating, or appertaining.
14. The Board of Governors of the Federal Waterways and Ports Authority shall exclusively define the boundaries of Federal Waterways and Ports Authority benefit districts, consisting of the premises and trajectories of the right of way for its FWPA waterway projects, and also for its integrated industrial, commercial, residential, agricultural, and or, aquatic or oceanic real estate developments and projects, including lands reclaimed from the sea and not quit-claimed, if any, notwithstanding the provisions of any other law, to be situated in international waters, or within such benefit district federal reservation areas, where either tribal governmental new jurisdictions or U.S. commonwealths shall be established, or alternately, are places where the laws of the United States and the administrative regulations to be adopted and revised by the Board of Governors of the Federal Waterways and Ports Authority, shall exclusively govern, and remain in full force and effect, and shall exclusively be enforced, the provisions of commonwealth or state constitutions or laws to the contrary, notwithstanding.
15. The Board of Governors of the Federal Waterways and Ports Authority shall license and regulate its agents, contractors, and subcontractors to perform necessary or convenient, professional or paraprofessional services, and skilled employment, or workforce labors, performed within the Federal Waterways and Ports Authority benefit district federal reservations. Such licenses shall be extended full faith and credit, and shall be reciprocal with, the like licenses, if any, issued by states and commonwealths of the United States, or by their political subdivisions.
16. The Board of Governors of the Federal Waterways and Ports Authority shall procure by purchase, or by utilization of its array of integrated manufacturing subsidiary firms, obtain the materials and supplies necessary to construct for the benefit of its real estate developments, maritime navigation, maritime passenger and freight transportation, and for water parks recreation purposes, and for pleasure craft recreational boating use, a nationwide network of ports, intercostal waterways, canals, residential lakes, recreational lakes, public water supply reservoirs, agricultural reservoirs and irrigation water supply systems, (with the impounded waters contained within the interconnected Federal Waterways and Ports Authority administered lakes and reservoirs constituting a strategic aqua-reserve available to insure that for agricultural production of food and during times of any agricultural state of emergency during years of lean or draught, foodstuffs for distribution to the domestic American market, that the crops grown within “America’s Breadbasket,” remains abundantly green and well-nourished even during seasons of lean or draught, when rainfall is scarce and agricultural cultivation or livestock raising is threatened) wildlife wetlands, combined or consolidated freight and passenger land-air-rail-sea ports (“LARS Ports”), with the “land” provision accommodating both over the road truck freighting and also railroad passenger and railway freight facilities, or enjoy the services of experts and consultants to aid in the works of implementing its projects, including, but not limited to, the disciplines of: the construction of canals, locks, dams, barge traffic, roads and highways, streets, curbs, gutters, water utility mains, sewer mains and treatment plants, natural gas pipelines, saltwater public water supplies for fish-farm utilization, railroad lines and spurs, public mass transit systems, domed places of metropolitan habitation having climate controls, airports, tunnels, bridges, use of tunnel boring machines, mining and quarrying, timber harvesting and milling, brick making, ceramics and glass making, residential, commercial, industrial, mixed-use, urban, suburban, or agricultural, development projects, hydroponics and fish-farming, shipbuilding, seaplane construction, hydro-electric power generation, providing a natural gas utility service, sanitary sewers, storm sewers, waste water treatments, providing public water supply utility service, water filtration and purification, the operation of waterfront recreational facilities and concession amenities, boat yards, convenience stores, snorkeling or scuba diving, multi-family housing, warehousing, railroad switchyard operations, the construction of medical centers, hospitals, and clinics, office buildings, skyscraper construction, golf course developments, private lake upscale gaited-community developments, recreational lake middle-class rental-community developments, subterranean real estate developments, all commercial developments within the FWPA benefit district federal reservations of residential lake communities, academies or guild training centers for the FWPA licensing of professions and/or the construction crafts and trades performing contract labors within the FWPA benefit district federal reservations., and to have all express or reasonably inferred powers, to carry out the powers hereinabove referenced, or is granted by law, or which powers are necessary or convenient, to faithfully execute the powers conferred by virtue of law upon the FWPA board of governors.
17. The FWPA board of governors shall establish and maintain administrative law judge federal courts, the judges of which shall be known as justice of the peace administrative law courts federal judges, who shall: by examination issue Title 5 U.S.C, Sec. 555(b) licenses; possess jurisdiction to adjudicate the violations of the Federal Waterways and Ports Authority administrative laws, and also the violations of administrative By Laws and infractions that are adopted by congressional township assemblies, which shall as punishment, levy a fine of not less than ten dollars nor more than one thousand dollars; conduct hearings and to enforce real estate restrictive covenants that ride with the land, with regard to residential parcels and commercial, industrial, or agricultural tracts of real estate situated within the FWPA benefit district federal reservations, and also, to appoint armed federal arbitral chief bailiffs and deputy bailiffs, who may carry, open or concealed, firearms, who shall provide arbitration and mediation hearing room security, make arrests for acts of contempt as shall be ordered by the justice of the peace administrative law courts federal judges and also for disorderly conduct or any breach of the peace perpetrated within his sight and hearing, have charge of detention holding cells and to perform arbitration material witness body attachments, provide for arbitral process executions, execute any arbitral writ of replevin, levy, sequestration, or garnishment.
18. The justice of the peace administrative law court federal judges shall establish a docket and sit as arbitrator for the purposes of the resolution of civil disputes including, but not limited to consumer, contractual relations, domestic relations, and tort disputes, arising among the firms and populations that are within the FWPA benefit district federal reservations. Except for the arbitration awards that are confirmed by courts of equity or law, in the manner that is prescribed by statute, the administrative law judgments of the justice of the peace administrative law court federal judges, may be appealed, and a trial de novo be conducted, before a United States District Court Magistrate Judge.
19. The board of governors of the Federal Waterways and Ports Authority shall establish and maintain a department of federal public safety rangers, who are hereby authorized to: provide air, land, and waterways police patrols, and police special agents who shall work within felony crimes investigations bureaus, cold case investigations units, administrative law violations strike forces, and also major crimes fugitive arrest teams, within the FWPA benefit district federal reservations; conduct aerial police, shore patrol boat, and road patrol and traffic law enforcement services; execute the legal process of the FWPA administrative law courts and to conduct investigations and make arrests with respect to the violation of Federal Waterways and Ports Authority administrative laws, regulations, or rules, and also to conduct investigations and make arrests with regard to the violation of any criminal law of the United States of America; to provide fire protection and related services, including but not limited to bomb squad and arson investigations (for which purposes the department of federal public safety rangers is hereby created as an auxiliary of the Bureau of Alcohol, Tobacco, and Firearms); to provide a marine-ground-air ambulance emergency medical response service; administer an emergency management and civil defense program for the benefit of the firms and populations that are within the FWPA benefit district federal reservations; establish and maintain jails and penal facilities for the detention of persons accused or convicted of administrative offenses or crimes; and, to have all express or reasonably inferred powers, to carry out the mandates and powers granted by law, or which powers are necessary or convenient, to undertake the responsibilities conferred by law upon the Federal Waterways and Ports Authority Department of Public Safety Rangers. The Commandant of the Department of Public Safety Rangers shall call to his aid, from time to time, any constables and deputy constables of the congressional townships; the arbitral chief bailiffs and arbitral deputy bailiffs; and also the congressional township reformatory police jailers, reformatory probation or parole officers, and reformatory police special agents, in their capacity as armed federal instrumentality local law enforcement officers, whose duty it is to conduct investigations and make arrests to apprehend: reformatory escapees, or inmates breaking custody from any reformatory penal halfway house, reformatory house arrest confinement, or any aspect of community corrections sentences; and also, with regard to any offenses committed by the conspirators and accessories of reformatory inmates and, to conduct investigations and make arrests to apprehend street gang offenders, or offenders committing infractions, or administrative law violations, that are committed within the FWPA benefit district federal reservations.
20. The board of governors of the Federal Waterways and Ports Authority shall engage in mortgage banking, and shall sell real estate loans on the secondary market, and shall make loans secured by a Deed of Trust, on real property, through credit unions, mortgage banks, thrifts and savings banks, and mortgage brokers, as a federal mortgage funding financial institution, to applicants desiring to acquire industrial, commercial, agricultural, or residential apartment leasehold estates, or to applicants desiring to acquire fee simple ownership single-family homes, duplex homes, tri-plex homes, or four-plex residential home loans to persons or firms, desiring land within the FWPA benefit district federal reservations.
21. The board of governors of the Federal Waterways and Ports Authority shall establish development loans and mortgage work-equity programs in order to avoid the payment of mortgage guaranty insurance premiums on mortgage loans where there is more than seventy-five percent (75%) loan to value ratios, for real estate: first time buyers, low-income buyers, minority buyers, divorced men and women buyers, individual buyers, newly married buyers, foster parent buyers, or legally adopted buyers, participating in such work-equity cooperative programs that waive otherwise required real estate loan down payments, for applicants who are successful in the completion of any construction trades work crew apprenticeship programs, that also well and faithfully perform qualifying hours of joint cooperative community service, with regard to joint community efforts to complete “barn raising” and “home raising” and “firm building” or “public works” cooperative labors, relating to the construction or real estate improvement projects for residential parcels or real estate improvements made to industrial, commercial, or agricultural tracts, that are situated within the FWPA benefit district federal reservations, and which will be financed with FWPA real estate loans to acquire fee simple home ownership or business leasehold estates, within the FWPA benefit district federal reservations.
22. The board of governors of the Federal Waterways and Ports Authority shall sponsor a credit union, to accept deposits and to make loans as a financial institution, for the use and benefit of the FWPA treasury, employees, firms and populations within the FWPA benefit district federal reservations, and to originate real estate loans, business loans, personal loans, automobile loans, equipment loans, and to issue certificates of deposit, credit cards, money orders, cashier’s checks, and all forms of negotiable commercial paper, debt instruments, and loans.
23. To promulgate enforceable real estate restrictive covenants that ride with the land, with regard to the FWPA approved real estate parcel or tract plats filed with the FWPA secretary, with regard to any quasi-municipal parks and recreation facilities, common areas, and also the residential parcels and commercial, industrial, and agricultural tracts of real estate, that are situated within the FWPA benefit district federal reservations.
24. The board of governors of the Federal Waterways and Ports Authority shall create and amend or relocate, the boundaries of homes associations, merchants associations, industrial or agricultural trade associations, and also quasi-municipal home-rule communities, within the FWPA benefit district federal reservations, and shall issue quasi-municipal charters authorizing home-rule under the New England Town Meeting (or Representative Town Meeting) form of government, with a Board of Selectmen as the executives thereof, and with such other quasi-municipal officials, board, bureaus, commissions, or agencies, and also local election authorities, as shall be specified within the terms of the home rule quasi-municipal charters for FWPA hamlets of up to five hundred persons, FWPA boroughs of from five hundred to five thousand persons, or FWPA metroplexes of over five thousand resident persons.
25. The board of governors of the Federal Waterways and Ports Authority shall establish and maintain, in each rectangular survey congressional township that is situated in whole or in part within the FWPA benefit district federal reservations, a calendar quarterly mass-meeting of registered voters, to be known as a Congressional Township Assembly, to be convened, except for adjournments, in plenary sessions at the hour of 7p.m. on the first Friday evening through 7p.m. Sunday evening, after the first Monday in January, March, June, and September. Each such Congressional Township Assembly shall have power to: elect a Federal Congressional Township Chairman, to be assisted by a federal congressional township Vice Chairman, Clerk, Bursar, Attorney, Parliamentarian, Constable, and also a 9 member board of regents possessing the legislative powers of the congressional township assembly when it is adjourned. Boards of Regents may call the congressional district assembly into special sessions exclusively for issues specified within the call to assembly. Each congressional township officer shall possess a term of office of one year expiring at the hour of eight (8:00) p.m. on the first Friday after the first Monday in January. The officers of congressional township assemblies shall each be paid emoluments, allowances, and his or her salary, by the board of governors of the federal waterways and ports authority. The Congressional Township Assembly shall have power to adopt and to file for record with the secretary of the FWPA board of governors, enactments to: adopt unique congressional township names, local place names and to authorize the erection of signs and markers, with regard to certain areas or portions of federal highways Interstate highways, and FWPA access highways and roads to petition congress for redress against wrong, adopt resolutions, memorialize legislative bodies, act as an amicus curiae with respect to the pending adjudication of litigation, and to adopt a Code of congressional township administrative By Laws and infractions, that are not repugnant to any United States law or administrative regulation or rule, violations of which By-Laws, shall be investigated, and arrests made, by congressional township constables and their federal highway patrols, in their capacity as armed federal instrumentality local law enforcement officers, and which congressional township By-Laws misdemeanor violations and also petty infractions or aggravated infractions are within the trial court jurisdictions of justice of the peace administrative law court federal judges, to be prosecuted in such FWPA administrative law courts by the congressional township attorneys, and by their deputies or assistants.
26. The board of governors of the Federal Waterways and Ports Authority shall establish and maintain for a fee, an annual registry of boats, vessels, motor vehicles, and aircraft, that are based within the FWPA benefit district federal reservations, and shall issue such stickers, placards, licenses, or permits, to be affixed and displayed thereon, and shall also prescribe and issue for a fee, annual licenses or permits to be carried upon the persons of the operators and crews within the FWPA benefit district federal reservations, thereto appertaining, which FWPA licenses and permits shall be extended full faith and credit, and shall be deemed to be reciprocal with the similar licenses, if any, that are issued by the states and commonwealths of the United States, and also which may be issued by the political subdivisions of any of the states or commonwealths.
27. The board of governors of the Federal Waterways and Ports Authority shall exclusively establish and maintain a system of: storm sewers; sanitary sewers; a water supply utility; an electric utility; a natural gas utility; a cable television or satellite television service; and also establish annual, periodic, weekend, or day access fees, granting public access to its projects and facilities, within the FWPA benefit district federal reservations.
28. The board of governors of the Federal Waterways and Ports Authority shall appoint or remove, or shall establish terms of office, for its administrative staff, executives, managers, supervisors, and administrative staff, skilled professionals and crews, and also the several three-man boards of trustees under paragraph 8 of this Act, holding title to voting shares of the capital stock of the federal waterways and ports authority, in order to perform the functions of the Federal Waterways and Ports Authority, within the FWPA benefit district federal reservations.
29. The board of governors of the Federal Waterways and Ports Authority shall establish and maintain: a network of intercostal waterways, canals, dams, locks, lakes, reservoirs and wet lands, LARS Ports, including but not limited to other improvements, such as levees, jetties, moles, docks, wharfs, and other improvements to real estate and also aquatic floating or oceanic surface or ocean floor improvements, buildings and facilities, airports, railroad lines, bridges, tunnels, service roads and access highways, irrigation systems, to be accessed for free, or by the site collection of tolls, within the FWPA benefit district federal reservations.
30. The board of governors of the Federal Waterways and Ports Authority shall posses the power of eminent domain for the purpose of acquiring aerial, ground, subterranean, and aquatic or oceanic interests in real estate, for its semi-private semi-public federal instrumentality purposes and functions within the FWPA benefit district federal reservations.
31. The FWPA board of governors shall have power to: establish and maintain among the congressional townships, quasi-municipal parks and recreation programs and shall for a fee, file for record and issue charters among the general public for congressional township: business trade names, trust indentures, articles of partnership, articles of limited liability companies, articles of incorporation for general business or nonprofit corporations; theaters; opera houses; arenas; convention centers; stadiums; and other special event services and related improvements, to provide entertainment, sporting leagues, contests, and teams; gaming casinos for the placement of wagers on games of skill or chance, and also off-track betting offices operating on the pari-mutuel wagering system, association formed for benevolent purposes, including any purely charitable society, hospital, asylum, house of refuge, reformatory and eleemosynary institution, fraternal-beneficial associations, or any association whose object is to promote temperance or other virtue conducive to the well-being of the community, and, generally, any association formed to provide for some good in the order of benevolence, that is useful to the public, any association, congregation, society or church organization formed for religious purposes, and any association formed to provide or maintain a cemetery; any school, college, institute, academy or other association formed for educational or scientific purposes, including therein any association formed specially to promote literature, history, science, information or skill among the learned professions, intellectual culture in any branch or department, or the establishing of a museum, library, art gallery, or the erection of a public monument, and in general, any association, society, company or organization which tends to the public advantage in relation to any or several of the objects above enumerated, and whatever is incident to such objects, may be created and may become a congressional township body corporate and politic under this provision, for the purposes of operating such organizations within the FWPA benefit district federal reservations; the board of governors of the Federal Waterways and Ports Authority shall have power to contract with native American tribal governments, and also to Native American cultural groups, to establish and maintain gaming casinos that accept wagers and pay winning bets on games of chance or skill, within the FWPA benefit district federal reservations.
32. The board of governors of the Federal Waterways and Ports Authority shall have power within the FWPA benefit district federal reservations, to promulgate, levy, and collect quasi-municipal administrative fees, in lieu of state and local taxes, which quasi-municipal administrative fees shall be paid by any nonresident workers, and also resident persons and firms, as quasi-municipal administrative fees to be paid in lieu of state and local taxes, which fees are deductible when itemized on a federal individual, federal fiduciary, federal partnership, or federal corporate tax return.
33. The board of governors of the Federal Waterways and Ports Authority shall have power to let contracts and to emit requisitions in order to gratuitously obtain without fee or charge, from wherever they may be situated upon any federal lands, timber, stone, minerals, water, and other natural resources, to be utilized domestically, or to be exported, or to be liquidated for cash to be dedicated to for the benefit of the various federal instrumentality real estate improvements and public services to be situated within the FWPA benefit district federal reservations; for FWPA capital accumulation purposes; and, for amassing adequate funds to be utilized for the payment of dividends to FWPA shareholders, each of which purposes shall promote national public convenience and necessity air-land-rail-sea transportation, economic, and national security needs.
34. The board of governors of the Federal Waterways and Ports Authority shall establish programs to create employment, private enterprise, and also cooperative organizations that are owned by their participating members, within the FWPA benefit district federal reservations.
35. The FWPA board of governors shall establish programs among offender paid, fee-based, congressional township reformatories, for: penal halfway house, penal work release, penal skilled workforce apprenticeship programs, and also penal furlough programs, for any model prisoners and also persons in close custody within one hundred and eighty (180) days of their release dates, and to also provide probation/parole counseling, and work projects for the supervised performance of court-ordered community service labors, for the benefit of the various improvements to be situated within the FWPA benefit district federal reservations.
36. The board of governors of the Federal Waterways and Ports Authority shall establish intercoastal waterways and canals linking its FWPA benefit district federal reservations with the Great Lakes, and with the other waterways, lakes, rivers, canals, and coastal waters of the United States.


37. The board of governors of the Federal Waterways and Ports Authority shall create inland salt water sport fishing lakes, and shall also establish and maintain facilities utilized to divert fresh water from near the mouths of rivers with their confluence with the coastal waters of salt water oceans and gulfs, and facilities to filter silt and chemicals from natural waterways, and shall redirect fresh waters, back to the headwaters of our nation’s rivers and streams, or to any other locations in order to provide waters for the FWPA lakes, public water supply and agricultural reservoirs and irrigation systems, canals, or intercostal waterways, in order to recycle and to stockpile, our nation’s fresh water natural resources, against the seasons of state of emergency draughts, that would otherwise lead to water rationing, crop failures, animal husbandry privations, dust storms, or widespread suffering among the people.


38. The board of governors of the Federal Waterways and Ports Authority shall have power to establish waterways or new courses for the flow of rivers and streams, waterfalls, and pools, including but not limited to purposes benefitting wildlife, flora, or fauna, and for the maintenance of meadows, flower beds, and green oasis places, or for restricted, or general recreation, or for other necessary or convenient public uses.


39. The board of governors of the Federal Waterways and Ports Authority shall implement its strategic long-term goals of establishing navigable federal waterways for maritime vessels and boats, providing arid areas with a reliable water supply while also providing adequate tactical aqua-drainage capability to relocate surplus waters from flood-prone areas, to the agricultural breadbasket and arid locations of the nation, while simultaneously providing for the construction of high-technology flood-control levees that combine flood-control with the additional priority functions of filtration of silt and chemical pollutants from the waters of America's principal and tributary river systems, resulting in working towards the goal of the restoration of clear-blue crystal clear fresh water rivers, with the totality of the situation also reducing America's dependence on foreign fossil fuels and OPEC oil purchases, due to the fact that one ton of cargoes transported for one mile by waterways significantly reduces the amount of diesel consumption otherwise required by long-haul freight trucking or railroad transportation methodology. The board of governors shall have power to restrict diesel propulsion system ocean-going vessels from enjoying access to the intercostal waterways and canals that it shall construct or operate, in order that no fossil fuel combustion engine toxic exhausts shall pollute the air within navigable waterways that utilize tunnel boring machines to obtain channels through mountainous areas, or within the intercostal waterways or canals serving climate-controlled domed FWPA hamlets, FWPA boroughs, or FWPA metroplexes.


40. The board of governors of the Federal Waterways and Ports Authority shall devise methods to perpetually capture energy from solar panels, windmills, wave generators, or other innovative technologies.


41. The Federal Waterways and Ports Authority shall be exempt from the provisions of law otherwise requiring environmental impact studies, land disturbance and prevailing wage, anti-trust, or monopoly laws, and shall enter into consultations with other federal agencies in order to balance the concerns of those various regulatory agencies with the mandates within this Act, creating the Federal Waterways and Ports Authority, and defining its instrumentality powers, duties, projects, and exemptions.


42. The Federal Waterways and Ports Authority shall enjoy the services of an Ombudsman General, who shall with his or her regional or local Ombudsmen and their deputies, shall represent the wants and needs of the people within the FWPA benefit district federal reservations.


43. The Federal Waterways and Ports Authority shall enjoy the services of a Master Inspector General, who under the inspector general public laws, shall investigate public complaints and conduct investigations relating to fraud, waste, or abuse, and to conduct audits, among the several other inspectors general, and also among the semi-public semi-private corporations, and other quasi-municipal corporate instrumentalities of the United States, and also for the benefit of any agency of the United States Government that does not have an inspector general assigned to it.


44. The Federal Waterways and Ports Authority shall create the capacity for US Naval ships, US Coast Guard vessels, and U.S. Merchant Marine vessels, to enjoy access to LARS ports, and to traverse through the Federal Waterways and Ports Authority benefit district federal reservations, that allows the US Navy, U.S. Coast Guard, and also U.S. Merchant Marine Fleets, safe-passage through the commonwealths and the several states of the United States of America, and to facilitate the need of such fleets to change oceans, by traversing and navigating the waters of certain designated national defense canals and intercostal waterways engineered to permit the largest ocean-going vessels to pass each other traversing the FWPA waterways in opposite directions.


45. The Acts of Admission to the Union relating to each of the states and commonwealths of the United States, and also the metes and bounds of all Indian reservations, are hereby deemed by operation of law, to be constructively amended, nunc pro tunc, to exclude from their respective jurisdictions and territory, the lands that are situated within the federal waterways and ports authority benefit district federal reservations, which now, or in the future, shall be established.


46. The World War II national security aspects of the intercostal waterways that protected U.S. Merchant Marine vessels from enemy warships, the pilot project successes of, among others, the McClellan Kerr Arkansas River Navigation System, (“MKARNS”) shows the feasibility and economic benefits of establishing and maintaining a national network of intercostal waterways, canals, and other bodies of water, notwithstanding the barriers of mountains, long distances, or arid places that would flourish if it had a more reliable water supply.


47. The examples of the United Arab Emirates creating artificial islands for residential purposes, and also of The Netherlands reclaiming lands from the sea, is the basis of the FWPA powers to: establish island-building projects through land-fill deposits of rocks and soils removed during the construction of FWPA intercostal waterways and canals, or otherwise, to abate the nuisance of shoal waters, rocks and reefs, constituting a hazard to navigation, and also land reclamation construction projects within aquatic and oceanic “dead zone,” oxygen minimum zones (OMZ). These OMZs are permanent or semi-permanent hypoxic and eutrophication areas in the world's oceans and large lakes, caused by excessive nutrient pollution from human activities, coupled with factors depleting the oxygen required to support most marine life, in bottom and near-bottom waters near inhabited coastlines. Dead Zones are places where it is difficult for marine life to be supported. Artificial barrier islands to abate the environmental nuisance-and-catastrophe of aquatic and oceanic dead zone OMZ’s, shall be constructed by the FWPA, acting jointly in concert with tribal governments and native American cultural organizations, resulting in the creation of man-made barrier islands which shall constitute the noncontiguous territorial jurisdictions of a United States commonwealth, consisting of a federation of constituent native American tribes, to be known as the commonwealth of Novamerica (Latin: New America). The land areas of the Commonwealth of Novamerica, except for any FWPA LARS ports or canals that are situated therein, shall be quit-claimed by the FWPA board of governors, to the commonwealth of Novamerica government, simultaneously upon admission of the commonwealth of Novamerica to the Union on an equal footing with all other commonwealths of the United States of America; by operation of law, the Commonwealth of Novamerica shall be automatically admitted to the union, upon obtaining a population of 100,000 persons and, upon securing a two-thirds ratification vote of each house of the Novamerica Provisional Legislature, consisting of 100 representatives and 50 senators, to be elected at a Novamerica constitutional convention, called for the purposes to draft a commonwealth constitution and also to elect all initial commonwealth public officials, at large, including a commonwealth governor, lieutenant governor, secretary of state, attorney general, treasurer, auditor, defender general, marshal, ombudsman, and also a delegate to the U.S. House of Representatives, and also further, by submitting a duly ratified Commonwealth of Novamerica constitution, to the United States of America National Archives.
