From what other claimant than the Internal Revenue Service would the bank consider accepting a claim as absolute without a court order? The answer is simply, “NO OTHER AGENCY OR CLAIMANT, NO GOVERNMENT, NO CREDITORS, could come into a bank and demand a depositor’s money solely on its own say so and get it. the banks know that private accounts are individual owners in the focus of a battle between the IRS and the indignant citizen! In the Donald McGrath case (Bite #19) for an unexplained tax charge of $39.65 the bank played a major part in killing a man! The Bank routinely spends more than $39.65 just for office coffee. 

Not only did the bank fail to compromise or give McGrath back his $39.65 but it spent substantially more in fighting McGrath in court over the note on his combine that was confiscated for an unexplained tax of $39,65. There are few lawyers in the world who would fight a $1500 battle when a $39.65 compromise would solve it but the bank fought out its battle and McGrath is forever dead! Even after the bank achieved its triumph over a farmer who represented himself in court, it still is not McGrath who looks crazy! 

The bank called in the sheriff to execute the judgment and repossess the combine deal. there are more than a few ways to collect a debt without ever forcing a confrontation with a man who they knew was fighting for his principles and not a small amount as $39.65! He wanted to know why he was billed. On that fateful morning the sheriff apparently knew that he was provoking a confrontation. He sent 3 armed men with the implement truck to confiscate the combine. Was anyone in doubt about how McGrath viewed the whole matter? One must wonder which side provoked and accomplished lethal violence?

McGrath is dead and even the local police testified that the deputy fired first. He fired into a car where there were 3 people but claimed only one of the 3 to be dangerous. In McGrath’s case all the rules for apprehending a criminal were abandoned! At that point McGrath’s case was a civil matter. It is normal law enforcement procedure for heroic attempts to be made without killing even an armed felon. Not here! Not even when innocent people are involved, such as McGrath, his wife and son. From whatever direction the McGrath killing is reviewed it fails to conform to the normal procedure of banks, sheriffs, police departments, or even courts!
