Often times, partisan passions flare up and frivolous calls to imprison political opponents are thrown around. This happens often enough that sometimes we lose sight of when a political figure genuinely merits an indictment. Now some are calling for the arrest and imprisonment of Berkeley’s liberal Mayor Jesse Arreguin under US code 2385:
“Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or
Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so;”
The questions are then:
Did Jesse Arreguin make statements that supported and emboldened actions or groups that can be reasonably construed to be attempting to overthrow or destroy the United States or any political subdivision therein?
Did Jesse Arreguin publish anything that could be constituted as promoting the use of force or violence as proper for destroying the United States Government?
Can the frequent attacks on conservative rallies and speaking engagements and the lack of violence at liberal rallies and speaking engagements be seen as proof of an establishment supported wave of violence against conservatives?
Some may scoff at the idea that there is an attack on conservatives today because we have a conservative president. We have swallowed the narrative that conservatives are a privileged group for so long that we quickly forget things like the scandal in 2013 when it was discovered that the IRS was targeting Tea Party groups. Was IRS Exempt Organization chief Lois Lerner held accountable by the Obama administration? Of course not, instead Obama blamed congress and Lerner was released with full pension. No surprise on June 13, 2014 the IRS first said it lost Ms. Lerner’s emails from 2009 to 2011. The IRS says hard drives and backups were destroyed for 6 other IRS employees too.
A search of examples of liberal rallies and speakers disrupted and terminated by right wing violence failed to turn up a single example.
But can his Tweets be construed as promoting violence against conservatives?
Given Berkeley’s violent history of radical leftist activism, it can be said that the mayor knew that radical factions would take it as an invitation to use violence to shut down free speech. This is especially true given that one of the most prominent radical Berkeley activists, Yvette Felarca, is on his friend list.
