If Congress Won't Do Anything, Sue
Well, at least he's doing something
Right under “Theives Steal Bull Semen” on the Drudge Report is the only
headline on Senator Rand Paul following through on a threat:
No empty words here. Rand Paul and FreedomWorks followed through on
their threat to sue the Obama administration on 4th Amendment grounds that the
national security programs that were revealed by the Edward Snowden leaks
following his theft of a government laptop computer and spilling the beans to a
reporter with a Watergate complex. From CNN
The suit also names National Intelligence Director James Clapper,
outgoing NSA Director Keith Alexander, and FBI Director James Comey.
...According to the lawsuit, the plaintiffs and class members want a
declaration that bulk metadata collection is unconstitutional, an end to it, and
an order to purge stored data that’s related to plaintiffs and class
members.
"Americans do not like to think of their government as some Orwellian
leviathan, engaging in surveillance tactics that we only expect to see in
oppressive autocracies," Paul writes in an opinion
piece for CNN.com. "That such surveillance could be going on in what is
ostensibly the freest nation in the world is a chilling thought
indeed."
To be honest, there isn’t much disagreement from the public on this, but
why sue? Why not sponsor legislation? After all, this is why the Rand Pauls of
the world were elected.
Suing to get their way is a favorite tactic of the left, and while
emulating their tactics is what it is going to take to beat the left, this topic
might well be better served with the expediency of legislation.
Ken Cuccinelli, a former Republican attorney general in Virginia who
lost the state’s gubernatorial election last November, is serving as lead
counsel. Cuccinelli predicted the lawsuit will pan out over several years.
“When the Supreme Court finally rules on these questions, Americans'
Fourth Amendment rights will be vindicated and we will prevail,” he
said.
Yes, if there aren't so many Obama appointees on the court to subvert
the Constitution just for the fun of it. And that is admittedly after several
years. By that time, are we sure ObamaCare won’t have completely destroyed the
place?
Good luck to Rand Paul, Ken Cuccinelli and FreedomWorks on this
endeavor. Patience and persistence will be required to follow through on this
one.
