Two of Fort Dix Five Want New Trial in Terror Plot
CAMDEN — Two Muslim brothers convicted five years ago as part of the Fort Dix Five terrorism plot want their convictions and life sentences thrown out, arguing again in a new federal court motion that they are innocent and did not receive a fair trial.
Dritan and Eljvir Duka, both of Cherry Hill, asked a judge to vacate the 2008 jury verdicts against them in the planned attack of the Army installation, and to set a new trial based on claims that their constitutional rights to effective assistance of counsel were violated.
The Dukas, with younger brother Shain and longtime friends Serdar Tatar of Philadelphia and Mohamad Ibrahim Shnewer of Cherry Hill, were convicted of conspiracy for planning an attack on Fort Dix and elsewhere in hopes of killing military personnel in their jihad, or holy war, in defense of Islam. They were acquitted of attempted murder.
The men, who are serving 30 years to life in prison, have always maintained their innocence. Their previous appeals have been denied, and last year the U.S. Supreme Court chose not to consider their case for review.
