After the March 1984 hearings were concluded a great silence emanated from the US Department of Education and from the media. Weeks passed and both acted as though nothing happened. Eagle Forum and many of the witnesses demanded that the testimonies at the hearings be published. The Department of Education's refused. After months of silence Phyllis Schlafly published the hearings herself, which she had a legal right to do since the typed transcript was a government document in the public domain.
The following testimonies of the seven days of hearings was published August 13,1984 under the title of “Child Abuse in the Classroom:” Three weeks later on September 6,1984 the Department of Education issued the strong regulations we have been demanding. On September 15, President Ronald Reagan, at the Annual National Eagle Forum Conference said this: “I’m happy to tell you today that new regulations to enforce the Pupil Rights Amendment, sometimes called the Hatch Amendment, have been completed by the Department of Education and were published in the Federal Register on September 6,1984. Like you, I believe that parents rights in education must be respected.
” These new Pupils Rights regulations went into effect on November 12,1984. They are the strong regulations which the witnesses in the March hearings have demanded. (page 9 and 10 of the book gives the text) These regulations spell out the pupil’s rights not to be subjected without the prior written consent of the parents---to psychiatric and psychological examinations and tests which means activities, attitudes, habits, traits, opinions, beliefs, or feelings, or to psychiatric or psychological treatment which means activities or instructions designed to affect behavior or emotional characteristics of any individual or group.
The final regulations do apply to the National Institute of Education (NIE) and the National Center for Education Statistics (NCES) which had been omitted from the proposed regulations in February 1978. Most witnesses at the March 1984 hearings had demanded their inclusion because the NIE is the fountainhead of most of the federally funded “therapy” masquerading as education. The NIE had spent millions of taxpayers dollars in controversial, unnecessary, and objectionable programs in the sensitive area of curricula development and teacher training which are not appropriate for the federal government at all!
