In the early fall of 1991 things began to come together when I met William Bentley Ball. A friend introduced me to a counsellor in law of the United States Constitution and religious rights. My case demanded litigation. Mr. Ball was later to write: “Your case, Robert Vernon, is direct and simple! Government may not invade the religious conscience of its citizens. People have constitutional rights to freedom of religious beliefs and associations. They may consult their minister, priest, or rabbi without reporting to government agencies. Under our Constitution religious tests for government offices is forbidden.
Acts and allegations of actual misconduct may be investigated but religious beliefs are protected against censure and even from disclosure. The city’s investigation violates this sacred principle. City officials deliberately went to the media to cast aspiration on you and publicize their attack, They stated openly that their investigation was intended to determine whether Chief Vernon’s conduct, (unquestionably illegal) was motivated by his religious based values. The object of this investigation was not Chief Vernon’s actions but his thoughts.”
After this I consulted the Board of elders at my church to be sure I would not take any action contrary to Scripture. Some churches believe we should turn the other cheek. My situation seemed covered by another principle. When the Apostle Paul was treated unfairly as a Roman citizen he demanded his rights. My situation seemed similar. I explained my position to the Board of Elders and they saw no reason why I should not proceed.
