#5 Inspection by parents or guardians of instructional material :
(also known as the Hatch Amendment) Section 439 “General Education Provisions Act” 20 US Code s1232h went into effect November 12,1984:

 a) All instructional material including teacher’s manual, films, tapes or other supplementary instructional material which will be used in connection with any research or experimentation programs or projects shall be available for inspection of the parents or guardians of the children engaged in such program or project. Research or experimentation means any project or applicable program designed to explore or develop new or unproven teaching methods or techniques. 

b) Psychiatric or psychological examinations, hearings or treatments: No student shall be required to submit to psychiatric examination, testing, or treatment in which the primary purpose is to reveal information concerning:

 1) political affiliation 

2) mental or psychological problems potentially embarrassing to the student and his family.

3) Sexual behavior and attitudes.

4) Illegal antisocial self incriminating and demeaning behavior.

5) Critical appraisals of other individuals with whose respondents have close family relations. 

6) Legally recognized privileges and analogous relationships such as those of lawyers, physicians, and ministers. 

7) or income other than required by law to determine eligibility for participation in a program or for receiving financial assistance under such program without the final consent of the student with written consent of the parent or guardian. 

=== Seven days of hearings were held by the Department of Education pursuant to the notes of proposed rulemaking to implement Section 439 which was published in the Federal registration on February 22, 1984. The all day hearings were held as follows:

Seattle, Washington, March 13,1984: Pittsburgh, Pennsylvania, March 16,1984: Kansas City, Missouri, March 19,1984: Phoenix, Arizona, March 20,1984: Concord, New Hampshire, March 21,1984: Orlando, Florida, March 23,1984: Washington DC, March 27,1984: The final regulations were published in the federal Register on September 6,1984 and went into effect November 12,1984. “The Hatch Amendment”
