#11 An Unjust Judge

An Unjust Judge:
As we proceeded toward the trial I began to look forward to putting the rumormongers on the witness stand for cross examination. I wanted those who had made the general allegations to be pinned down to specifics. On February 25,1992 we had our next appearance in court. The defense had asked the judge to throw the case against them out before we even got to trial. William Bentley Ball had flown out from Pennsylvania to represent me.
When the hearing began the following exchange took place between Ball and the Judge: I ask you first to tell me in response to the comment I make. What inquiry do you make other than the fact that this investigation was started? When Ball began to discuss the key issues of the case the judge cut him off in mid sentence. Judge: Respond to my inquiry. If you don’t intend to respond to my inquiry then I don’t want to hear from you! Ball:
This has been a very chilling effect on Mr. Vernon’s religious profession. Judge: Mr. Ball you may be seated! Ball then sat down. He had thoroughly prepared to present briefly the basic issue of my case but the judge would not allow him to do so. He wanted to present the fact that the investigation had been ordered because of my religious beliefs. It was an investigation conducted against damaging press release by the city without any specific charge made.
The judge allowed the defendant’s attorney to comment liberally on their position but when Ball stood to explain the bare facts, once again, the judge cut him off. Judge Wilson, in his original 42 page decision remarked that the investigation’s consequences in particular concluded that the plaintiff was not guilty of on duty wrongdoing and putting to rest the allegations and rumors was the reason full summary judgement was granted to the city.
Many people had been watching the series of events unfold. One could see the sinister message in the results so far: If you have any religious beliefs keep them secret. Don’t talk about them even in your church or synagogue. If someone in power disagrees with your beliefs he can hold you up to public ridicule.
